These Terms of Service govern your access to and use of Aftir and its memorial, My Legacy, media, and remembrance-related services.

Acceptance of Terms
By accessing, creating an account with, purchasing from, or otherwise using Aftir, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you should not use the platform.
If you use Aftir on behalf of another person, family, organization, or business, you represent that you have authority to accept these Terms on their behalf.
About Aftir
Aftir is a platform dedicated to preserving memories, honoring lives, and helping individuals document their own stories for future generations. Aftir provides tools for creating memorial pages, My Legacy pages, media galleries, Trusted Contact arrangements, Future Messages, Video Releases, Time Capsules, premium memorial features, and related remembrance services.
Some features are available at no cost, while others require a one-time purchase or subscription. Features, pricing, storage limits, and availability may change as Aftir evolves.
Eligibility
You must be at least 13 years old to create or use an Aftir account. If you are under the age of majority where you live, you may use Aftir only with the involvement and permission of a parent or legal guardian.
User Accounts
Users may create accounts to manage memorials, My Legacy content, uploaded media, purchases, settings, and related features.
- You must provide accurate and current account information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for activity conducted through your account.
- You must notify Aftir promptly if you believe your account has been accessed without authorization.
- You may not sell, transfer, or share your account in a manner that compromises security or ownership rights.
User Content
Users may create memorials, My Legacy pages, stories, memories, comments, captions, and other content, and may upload photographs and videos.
You retain ownership of content you submit. By uploading, publishing, or otherwise providing content to Aftir, you grant Aftir a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, transmit, and make the content available as reasonably necessary to operate, maintain, secure, and improve the platform and to display content according to your settings and publishing choices.
This license ends when the content is deleted from Aftir, except where continued retention is required by law, necessary for security or dispute resolution, or reasonably necessary to complete an account deletion or content-removal process.
Content Responsibility and Acceptable Use
You are solely responsible for content you upload, publish, schedule, deliver, or share through Aftir.
By submitting content, you represent and warrant that you own it or have obtained all permissions, licenses, consents, and rights necessary to use and publish it.
You may not use Aftir to upload, publish, transmit, or facilitate content or activity that:
- Violates any law, regulation, court order, or legal right.
- Infringes copyrights, trademarks, privacy rights, publicity rights, or other intellectual property rights.
- Is fraudulent, defamatory, threatening, harassing, hateful, abusive, exploitative, or malicious.
- Contains malware, destructive code, automated attacks, scraping tools, or attempts to disrupt or misuse the platform.
- Impersonates another person or falsely claims authority, ownership, identity, or family relationship.
- Contains private or sensitive information that you do not have permission to disclose.
- Uses Aftir for spam, unauthorized advertising, unlawful solicitation, or deceptive commercial activity.
Aftir may investigate reported content and may remove, restrict, unpublish, or preserve content when reasonably necessary to enforce these Terms, protect users, comply with law, resolve disputes, or protect the platform.
Memorial Ownership and Authority
The person who creates and controls a memorial is responsible for ensuring that they have a legitimate basis to create, manage, publish, and share it.
Aftir does not independently verify every claimed family relationship, legal authority, ownership interest, or right to represent a deceased person. If competing claims arise, Aftir may request documentation, temporarily restrict access, unpublish content, preserve records, or take other reasonable action while reviewing the dispute.
Aftir does not guarantee that it can resolve every family, estate, ownership, or memorial-management dispute. Users are encouraged to resolve disagreements privately or through appropriate legal channels.
My Legacy and Post-Passing Features
My Legacy and related features allow users to preserve personal stories, media, instructions, messages, videos, and other materials for future access or delivery.
Trusted Contacts and recipients must be selected carefully. You are responsible for providing accurate contact information, keeping it current, and ensuring that the people you designate are appropriate for the responsibilities assigned to them.
Future Messages, Video Releases, Time Capsules, passing-confirmation workflows, and related features depend on account settings, Trusted Contact actions, scheduled dates, technical systems, email delivery, and other conditions. Aftir does not guarantee that any message, video, time capsule, or other item will be delivered, released, accessed, or received at a particular time or under every circumstance.
Aftir is not a will, trust, estate-planning service, funeral service, legal service, or substitute for professional legal, financial, medical, or estate advice.
Passing Confirmations and Disputes
Certain Aftir features may rely on reports or confirmations concerning whether an account owner has died. These processes are intended to help administer legacy features but cannot guarantee the accuracy of every report.
Aftir may delay, suspend, reverse, or review a passing confirmation when information is incomplete, disputed, inconsistent, or reasonably believed to be inaccurate.
Public and Private Content
Content may be public, private, unpublished, restricted, or shared through direct links depending on the feature and settings selected.
You are responsible for reviewing your publishing and privacy choices. Public content may be indexed by search engines, shared by others, copied, archived, or remain accessible outside Aftir after it is removed from the platform.
Comments, Memories, Reactions, and Community Features
Aftir may allow visitors or registered users to submit memories, comments, candles, reactions, or similar interactions. Memorial owners may have tools to approve, reject, remove, or manage certain submissions.
Memorial owners may delete memories submitted to memorials they control. When a memorial owner uses the Block & Report User option for content submitted by a registered user, the reported memory is removed from the memorial, the reported user is blocked from viewing or contributing to the reporting user's memorials, and a private copy of the reported memory is preserved for Aftir's administrative review.
Reports should be submitted in good faith and must not be used to harass another person, make knowingly false claims, manipulate the platform, or interfere with lawful use of Aftir. Submitting a report does not guarantee that Aftir will take additional action against the reported account.
Aftir may review reports and related records and may dismiss a report, preserve relevant information, remove or restrict content, limit access, or take other reasonable action permitted by these Terms. Expanded enforcement measures may be introduced as Aftir's moderation tools evolve.
Aftir does not endorse user submissions and is not responsible for their accuracy. We may remove or restrict submissions that violate these Terms or create legal, safety, or operational concerns.
Premium Features, Pricing, and Payments
Some Aftir features require a one-time purchase or subscription. Current pricing, included features, storage limits, and billing terms are displayed at or before checkout.
Payments are processed by Stripe. By making a purchase, you agree to provide accurate billing information and authorize the applicable charge.
Aftir may change prices or feature availability prospectively. Price changes will not retroactively increase the amount already paid for a completed one-time purchase.
Subscriptions, Cancellations, and Refunds
Subscription features remain available for the applicable paid term, subject to these Terms. Users are responsible for canceling subscriptions before renewal when they do not wish to continue.
Except where required by law or expressly stated at checkout, payments are nonrefundable once a digital feature, premium upgrade, or subscription term has been activated. Aftir may issue refunds or credits at its discretion in cases involving duplicate charges, verified technical failures, or other exceptional circumstances.
Canceling a subscription stops future renewal but does not automatically delete an account or user content. Access to subscription-only features may end when the paid term expires.
Account Deletion
Users may request account deletion through their account settings or Aftir's public Account Deletion page.
Account deletion requests are subject to a 30-day grace period during which the request may be canceled. After the grace period and required deletion review, eligible account information, user content, memorials, My Legacy content, uploaded media, and associated records may be deleted, anonymized, reassigned, or retained as described in Aftir's Privacy Policy and Account Deletion process.
Certain limited records may be retained when reasonably necessary for legal compliance, accounting, fraud prevention, user safety, security, dispute resolution, enforcement, or protection of other users' rights. These records may include blocking records, reports, preserved copies of reported content, administrative review notes, and related audit information, as further described in Aftir's Privacy Policy.
Suspension and Termination
Aftir may suspend, restrict, unpublish, or terminate accounts or content when reasonably necessary to enforce these Terms, protect users, investigate fraud or abuse, respond to legal requests, resolve ownership disputes, or protect the platform.
Where appropriate, Aftir may provide notice or an opportunity to correct a violation, but we are not required to do so in urgent, unlawful, fraudulent, harmful, or security-related situations.
Availability, Changes, and Data Preservation
Aftir is intended to serve as a long-term remembrance and legacy platform, but uninterrupted availability, permanent storage, flawless delivery, and indefinite preservation cannot be guaranteed.
We may update, modify, replace, suspend, limit, or discontinue features. We may also perform maintenance, migrate systems, change storage methods, or impose reasonable technical limits.
Users should retain independent copies of important photographs, videos, messages, and other irreplaceable content. Aftir should not be treated as the only backup of important materials.
Aftir Intellectual Property
Aftir and its licensors retain all rights in the platform, including its software, design, branding, logos, text, graphics, workflows, databases, and other proprietary materials, excluding user-owned content.
You may not copy, reproduce, modify, distribute, sell, license, reverse engineer, scrape, or create derivative works from Aftir's proprietary materials except as expressly permitted by law or in writing by Aftir.
Copyright and Intellectual Property Complaints
If you believe content on Aftir infringes your copyright or other intellectual property rights, contact support@aftir.net with sufficient information to identify the work, the allegedly infringing material, your contact information, and the basis for your claim.
Aftir may remove or restrict disputed content while reviewing a complaint and may terminate accounts associated with repeated infringement.
Third-Party Services and Links
Aftir may rely on third-party providers, including Stripe and IONOS, and may contain links to third-party websites or services. Aftir is not responsible for third-party content, availability, privacy practices, security, or terms.
No Professional Advice
Information and features provided through Aftir are for remembrance, storytelling, communication, and organizational purposes only. Nothing on Aftir constitutes legal, estate-planning, financial, medical, mental-health, funeral, or other professional advice.
Disclaimer of Warranties
Aftir is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Aftir disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, availability, accuracy, security, and uninterrupted operation.
Limitation of Liability
To the maximum extent permitted by law, Aftir and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, emotional distress, failed delivery, missed release, unauthorized access, or other losses arising from or related to use of the platform.
To the maximum extent permitted by law, Aftir's total liability for any claim arising from or related to the service will not exceed the amount you paid to Aftir during the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars if you paid nothing during that period.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Aftir and its owners, officers, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from your content, your use of the platform, your violation of these Terms, or your violation of another person's rights.
Governing Law and Venue
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any legal action arising from these Terms or use of Aftir must be brought in a state or federal court with jurisdiction in Indiana, and you consent to the jurisdiction of those courts.
Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Aftir's failure to enforce any provision does not waive its right to enforce that provision later.
Entire Agreement
These Terms, together with the Privacy Policy and any additional terms presented for specific purchases or features, constitute the entire agreement between you and Aftir regarding use of the platform.
Changes to These Terms
Aftir may update these Terms as the platform, business, or legal requirements evolve. Updated Terms will be posted on this page with a revised date. Continued use of Aftir after updated Terms become effective constitutes acceptance of the revised Terms.
